Internal Committee (under POSH Act)

The Parliament of India passed the “Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act,” in the year 2013. The Act provides protection against sexual harassment of women at workplace and for the prevention and redressal of complaints of sexual harassment and for the matters connected therewith or incidental thereto. The act requires every employer of a workplace shall, by an order in writing, constitute a committee to be known as the ‘Internal Committee under POSH Act’ and abide by such act. The committee includes a presiding officer who is a senior-level woman employee, two internal faculty members, two non-teaching members, three students and one external member from NGO (preferably an advocate).
In sexual harassment at workplace, “It is impact, not intent that matters”. Sexual Harassment at workplace includes such as unwelcoming sexually determined behavior (whether directly or by implication)as:

  • Physical contact and advances
  • A demand or request for sexual favors
  • Sexually colored remarks
  • Showing pornography
  • Any other unwelcome physical, verbal or non-verbal conduct of sexual nature
